I-9 Issues

You’ll receive a Department of Homeland Security (DHS) Verification in Process response, meaning the government is performing a manual review of your employee’s records. Although you’ll receive results within 48 hours, if your employee’s I-9 information still doesn’t match government records, E-Verify will send you a Tentative Nonconfirmation (TNC) notice explaining the problem in more detail. Your worker has eight federal work days to resolve the issue while he/she continues working for you. Since you can’t do anything unless you receive a final nonconfirmation notice, you’ll spend even more time waiting for your employee to resolve the problem.

Photo Matching Complications
Even though you must ensure your employee’s picture shown in E-Verify matches the one on the document your worker submitted with the I-9, chances are the picture won’t trigger photo matching in E-Verify. This is typical of a driver’s license, Permanent Resident Card, Form I-766, or U.S. passport. Your employee will receive a TNC and must correct the issue, causing you even more waiting time and potential stress.
